La Family Division della High Court dell'Inghilterra e del Galles ha stabilito che è possibile sospendere la ventilazione meccanica di un bambino colpito da gravissime lesioni cerebrali, nonostante l'opinione contraria, dettata da ragioni di carattere religioso, espressa dai genitori e nonostante ciò ne causi inevitabilmente la morte.

Secondo il giudice Hedley J., il parere pressoché unanime del personale medico coinvolto nella vicenda nel senso di non poter prospettare alcun miglioramento nelle condizioni del bambino, costituisce elemento determinante per dichiarare la legittimità della sospensione del trattamento di ventilazione meccanica.
Non si tratta di un ordine della Corte, quanto piuttosto di una preventiva dichiarazione di legittimità della eventuale sospensione della ventilazione, che permette di realizzare il best interest del bambino.

«[…] the staff (who speak as one on this issue) have concluded that it is no longer in X's best interests to remain on artificial ventilation as no improvement is to be expected and that this treatment has now become futile».
«[…] the tenets of their faith prevent their giving their consent in the present circumstances to a course which will almost inevitably lead to death».
«[…] In the end I have to conclude that X's welfare requires his removal from ventilation on to palliative care. As this may result in a very speedy death, it will of course require planning and management. I know of no reason why that cannot in due course be agreed between the treating team and the family».
«[…] I reach the conclusion that X should in future be treated on the basis of palliative care. This is, of course, not an order of the court. It is a declaration that so to treat would be lawful as being in X's best interests. The treating team must of course satisfy themselves that that remains the case when they decide to withdraw ventilation and/or decline any other aggressive, invasive treatment».
